Final Pay and Separation Pay 2026 Philippines: Rules and Computation

Requirements
- Clearance process of your company, if any. It should not delay pay beyond the 30-day rule.
- Returned company property (ID, laptop, tools), if asked.
- Your last payslip and employment contract, to check the amounts.
- Your job ended because of redundancy, labor-saving devices, retrenchment, closure not due to serious losses, or a disease that makes work unsafe.
- Written notice from your employer. Notice to you and DOLE is usually required at least 30 days before.
- Medical certificate from a public health authority for disease cases.

Final pay held until "clearance" is done
Clearance should not delay pay beyond 30 days. Ask HR for a date in writing.
Resigned and asked for separation pay
By law, resigned workers do not get separation pay unless your contract or policy gives it.
Unused leave not paid
At least 5 days of service incentive leave per year can be converted to cash if unused.
Big deductions from final pay
Ask for a written list. Only lawful deductions, such as company loans you agreed to, are allowed.
Did not get BIR Form 2316
Your employer should give it with or after your final pay. You need it for your next job.
Years of service with a few extra months
